# Belastingdienst steeds kritischer op de vestigingsplaats voor de btw

Sinds het Verenigd Koninkrijk de EU heeft verlaten, zien wij dat de belastingdienst steeds kritischer is op de vestigingsplaats van Nederlandse vennootschappen met een buitenlandse board. Bij het ontbreken van een Nederlandse board, is een vennootschap voor belastingdoeleinden niet in Nederland gevestigd, met alle praktische btw gevolgen van dien.
Het kon niet lang uitblijven dat hierover geprocedeerd zou worden en recent heeft de Rechtbank in Den Haag dit standpunt in een specifiek geval bevestigd. De Rechtbank kwam tot de conclusie dat de vestigingsplaats van een naar Nederlands recht op gerichte vennootschap Spanje is, omdat de beslissingen van het bedrijf daar worden genomen door de algemene leiding, de DGA/bestuurder die daar woont en verblijft.
