It will not have escaped your notice, the business succession scheme in income tax and gift and inheritance tax is under fire. The scheme may soon be scaled down or even abolished altogether.

If in your situation a business succession is in the offing, it makes sense to consider whether it is feasible to start the process earlier, so that you can still take advantage of the current broad regulations. In doing so, however, do not lose sight of the non-tax aspects of a business succession. For example, what is the importance of your personal arrangements (prenuptial agreements and wills), whether the intended successor is already ready to take over your business and what the impact of a business succession is for the children who do not succeed you.

Legal and tax aspects of business succession

During our knowledge session, we will use a case study to illustrate the importance of good prenuptial agreements/partnership agreements and wills, both in general and in the context of a possible future business succession.

In addition, using the same case, we will discuss the use of business succession schemes and what this means from a tax point of view. These schemes can offer many tax advantages, but time may be running out. There is a possibility that the business succession schemes in their current form will be abolished or scaled down from 1 January 2023.

Using our special software, we also provide insight into the financial benefits of being able to apply the current business succession schemes and the impact of no longer being able to apply these schemes.

The knowledge session will take place in the autumn, so any developments concerning the business succession schemes announced during Budget Day will also be discussed.
